Image Use Consent Information

BACKGROUND

Merz Aesthetic UK LTD (Merz) is the name of the company that supplies the innovative products, equipment, and technology that you are using and discussing in your testimonial.

Merz is part of a larger group of affiliate companies, that works in the medical, pharmaceutical, and aesthetic fields in close connection with experienced and trusted practitioners.

PURPOSE

The below statements collectively define the ‘Purpose’ of the consent form and the processing of your personal data:

• I understand that Merz wishes to use my experiences in relation to Merz treatments, products, training sessions and events, as part of an endorsement for other customers and healthcare practitioners.
• I understand that Merz will use the images, which may include still or moving images in any medium or form, (Images) taken of me in relation to the use and receipt of Merz products for the purposes of the endorsement and in the mediums set out below.
• I understand that Merz will use the comments, testimonials, feedback and any quotes (including in any audio or video recordings) which I may voluntarily give (Content) for the purposes of the endorsement and in the mediums set out below.
• At all times careful decisions will be made about how Merz will use the Images and the Content. However, it is important that you understand you will not be asked to approve any Images or finished Content materials before they are used.

By agreeing to the image consent information, I agree that Merz, its affiliates, and those practitioners and clinics who use Merz’s services may publish the Images and Content for 5 years in edited or partial versions for the purpose as set out below. Merz shall never edit any content in such a way as to create a misleading impression of my views. Your name and profession may be used in the endorsement, however, we will never reveal exactly where you live.

FURTHER LEGAL INFORMATION

Merz will store your contact details- from time to time, Merz may need to contact you later about the use of the Images or Content. Any contact details that Merz stores will be held securely. 

In the highly unlikely event that there is ever a disagreement about this form that you and Merz cannot settle privately, the matter will be decided by English courts using English. However, if you reside in another country, you have the right to have your claim heard in the courts and under the laws of that country.  

You have the right to withdraw your consent to Merz using the Images or any of the Content at any time. This must be done by notifying Merz in writing of your withdrawal at the following address: customerservices@merz.com.

Merz shall use its reasonable endeavours to remove any Content or Images which it has used. However due to the nature of social media and the internet, Merz makes no guarantees or warranties regarding the complete removal of any Content or Images. From the date of withdrawal of consent Merz shall cease to use any Images or Content for any future use.

PERMISSION

I confirm that:

• I grant Merz and its affiliates permission to use the Images and Content, in accordance with the defined Purpose, as an endorsement, in its original format or edited or altered in any way which Merz and its affiliates deems appropriate, throughout the world for any of its commercial or non-commercial purposes, including:
  • Social Media Posts
  • Website
  • Publications (print and online)
  • Promotional Materials (print and online)
  • Advertising (print and online)
  • Educational purposes (webinars and training events)

• I do not object to Merz storing copies of the Images or Content for the Purpose or to it storing my contact details on its database in case Merz needs to contact me in connection with the Purpose. 

This Agreement shall be governed and construed in accordance with the laws of England. You agree to the exclusive jurisdiction of the courts of England. However, if you are a consumer and live in Scotland, Northern Ireland, or the Republic of Ireland you can bring legal proceedings in the Scottish, Northern Irish, Republic of Ireland or the English courts.

Your data will be stored and managed in accordance with the Data Protection Act 2018 and the UK General Data Protection Regulations (UK GDPR) and any subsequent or superseding data legislation.
